Section 1: Definitions
All Around Music LLC is a limited liability company with its principal place of business located at 6580 Monona Drive #1086 Monona WI US 53716. In this Privacy Policy, All Around Music LLC may also be referred to as All Around Music, we, us, or our.

Information is any data, personal or otherwise, that is:
a. transferred from you to All Around Music, regardless of its country of origin, and
b. recorded in any form.

Personal Information pertains to a specific individual, whether the individual is you or not, and can be linked to that individual.
Sensitive Personal Information means Personal Information that reveals race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, trade union membership, or concerns an individual’s health.
The Website includes all pages and content found or accessed under the All Around Music domain name www.allaroundmusic.us.

Software includes all programs, routines, and symbolic languages downloaded or accessed through the Website or Web Portal or otherwise provided by All Around Music that control any functionality or direct any operations on a computer or other device.
Collectively, the Website, Web Portal, Software, and any related email or SMS communication tools are referred to as the Services.

User means anyone accessing or using the Services provided by All Around Music, whether they are registered Users, guests, or internet Users, even if they did not directly access the Service used. It also includes persons using the Service even if they are accessing the Service through another person’s account.

Section 2: What Information All Around Music Collects and Why
Any time a User accesses the Website or Web Portal, they receive a cookie from us. We use cookies, which are small pieces of data stored for an extended period on a computer, mobile phone, or other device, to make the Services easier to use and to protect both you and All Around Music. These cookies give All Around Music Information about your use of the Services. As part of registering as a User, All Around Music requires you to input a Username, password, and a valid email address. All Around Music stores and compiles this data and may retain it from Users who have terminated their accounts for legal compliance purposes or to maintain the ongoing confidentiality, integrity, availability, and resilience of All Around Music systems, Website, and Service.

When you choose to receive communications from All Around Music, we may also collect:

This Information is provided in part through All Around Music use of Google Analytics and Facebook Pixel and other similar tools.
As part of the Service, All Around Music also records all teaching lessons, including video, audio, and chat features of both Instructors and Users. These recordings are used solely for the purpose of ensuring quality and legal compliance and will never be shared with third parties unless required by law.

If you pay for Services online, your payment card or bank account information is processed by a third party payment processor. All Around Music receives limited payment related Information such as transaction date, amount, and a confirmation that payment has been completed. Use and storage of your full financial information is governed by the privacy policy of the applicable payment processor.

Section 3: What Information All Around Music Does Not Collect
All Around Music does not intentionally collect Sensitive Personal Information. While All Around Music does not request this Information, we recognize that you may store some Information of this kind in your account or in communications sent through the Services. If you choose to keep Sensitive Personal Information in your account or private storage, you are responsible for complying with any regulatory controls regarding that data.

Section 4: How All Around Music Uses Collected Information
All Around Music uses Information provided to operate the Service and to contact you regarding changes, updates, account Services, customer Service, or any other reason associated with the Service or your use of the Service.
All Around Music may contact you with Service related announcements from time to time. These include necessary Software updates and Web Portal or Website outages, among other things. All Around Music requires an email address to become a User so that All Around Music can make these communications. You may opt out of all communications except essential updates that relate to safety, security, or the proper functioning of the Service.

All Around Music may also contact you with direct advertisements related to your use of the Services. These can include potential upgrades, Service options, or other offerings. If you provide your mobile number and consent to receive SMS text messages, All Around Music may use your Information to send:
a. account and Service messages such as booking confirmations, reminders, schedule changes, and important notices about your account or lessons
b. customer support messages responding to your questions or requests
c. marketing messages about new Services, promotions, special offers, events, or features that may be of interest to you.
Message frequency will vary based on your interactions with All Around Music. Message and data rates from your mobile carrier may apply.

Your consent to receive SMS marketing messages is voluntary and is not a condition of purchasing any Services from All Around Music. You may opt out of marketing SMS messages at any time as described in Section 5 and Section 9 of this Privacy Policy.
All Around Music may use vendors and service providers to deliver SMS text messages on its behalf. These providers are permitted to use your Information only to support All Around Music in sending and managing those messages.

After you send the SMS message STOP, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive marketing SMS messages from us. If you want to receive SMS messages again, you can reply START or contact us at contact@allaroundmusic.us to reenroll.

You may also manage your communication preferences, including whether you wish to receive marketing email or SMS text messages, by contacting All Around Music at contact@allaroundmusic.us.
Please note that even if you opt out of marketing communications, All Around Music may still send you non marketing messages that are necessary to provide the Services, such as booking confirmations, lesson reminders, or important notices about your account.

Onward Transfers
Prior to disclosing Personal Information to a third party, All Around Music will notify you of the disclosure and allow you the choice to opt out, except where such disclosure is required by law. All Around Music will ensure that any third party to which Personal Information may be disclosed is subject to law providing the same level of privacy protection or agrees in writing to provide an adequate level of privacy protection, including with respect to email and SMS communication services.

Data Security
All Around Music shall take reasonable steps to protect the Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. All Around Music has in place appropriate physical, electronic, and managerial procedures to safeguard and secure the Information. All Around Music cannot guarantee the security of Information on or transmitted via the Internet or through SMS networks.

All Around Music shall only process Personal Information in a way that is compatible with and relevant to the purpose for which it was collected or has been authorized. To the extent necessary for those purposes, All Around Music shall take reasonable steps to ensure that Personal Information is accurate, complete, current, and reliable for its intended use.

Access
All Around Music will allow you access to your Personal Information and allow you to correct, amend, or delete inaccurate Information. For access requests, please contact contact@allaroundmusic.us. Access will not be allowed where the burden or expense of providing access would be disproportionate to the risks to your privacy or where personal rights other than your own would be violated. Access will only be granted a maximum of two times during any twelve month period. While accessing your Information, you will be allowed to export a copy of your Information.

All Around Music will keep your Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including for the purpose of satisfying any legal, accounting, or reporting requirements and for the establishment, exercise, or defense of legal claims. When we decide how long to keep Information, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and whether we can achieve those purposes through other means.

All Around Music uses a self assessment approach to assure compliance with this Policy and at least annually verifies that the Policy is accurate, comprehensive, prominently displayed, completely implemented, and accessible to remain in conformity with the GDPR and the CCPA.

Dispute Resolution
All Around Music encourages you to raise any concerns using the contact Information we have provided. We will investigate and attempt to resolve any complaints and disputes regarding the use and disclosure of Personal Information in accordance with the GDPR and the CCPA. If a complaint or dispute cannot be resolved through our internal process, we agree to dispute resolution using the small claims courts of Wisconsin as a third party resolution provider.

Section 6: How All Around Music Treats Information from Children Under 13 Years Old
All Around Music is a Website that provides online music lessons using video conference technology. We welcome students of all ages and as such are compliant with the Children’s Online Privacy Protection Act of 1998. We therefore take special precautions when collecting personal information from children under the age of 13.

Children’s privacy law requires that we inform parents and legal guardians about how All Around Music collects, uses, and discloses personal information from children under the age of 13 years. Furthermore, this law requires that we gain consent from parents and or legal guardians in order for children under the age of 13 years to use certain features of our Website.
What information is collected from children

We do not collect personal information from children unless they register on the All Around Music Website. The only personal information that is collected during the registration process is the parent email address, the student and parent name, booking information, and any recordings made by All Around Music in providing the Service.

Any and all recordings made by All Around Music will be used solely for the purpose of ensuring quality and legal compliance and will never be shared with third parties unless required by law. These recordings will be considered confidential and will be treated as such by All Around Music.

All Around Music requires a registering user age prior to registration. If the user is under the age of 18, he or she is prompted to provide a parent or guardian contact information so that All Around Music can communicate with the parent or guardian regarding the account.

All Around Music does not share user information with third parties unless stated otherwise in this Privacy Policy or under special circumstances described in Section 8.

How is the information collected used
All Around Music uses the information collected during the registration process to communicate with users and provide Services. The information collected is never sold to unaffiliated third parties.

By using All Around Music Services, you may be granting access to personal information to third parties including Google. All Around Music uses Zoom to provide lesson Services, therefore you may be granting Zoom additional rights to the live content that is streamed during the lesson. By purchasing and allowing your child to participate in online lessons, you are consenting to potential third party information exchange. Use of Zoom is governed by its own Terms and Privacy Policy.

How do we notify and obtain consent from parents regarding their children information
If your child under the age of 18 years attempts to register with the All Around Music Website, he or she will be prompted to provide parent or guardian contact information. By purchasing classes for your child under the age of 18, parents and guardians are consenting to the collection of their child information.

What access and rights do parents have
Parents and guardians have the right to review the information that has been collected from their child. Parents and guardians additionally have the right to withdraw consent for the use or collection of personal information from their child and may request that their child information be deleted from the All Around Music system.

Section 7: How All Around Music Secures Your Information
Data All Around Music receives from you is stored on All Around Music Website or in Zoom cloud storage and may also be stored with secure third party email and SMS service providers as necessary to provide the Services.
All Around Music uses technical, administrative, and physical safeguards that are designed to improve the confidentiality, integrity, and accessibility of your Personal Information. These safeguards may include encryption, access controls, regular security reviews, and staff training.

Despite these efforts, no method of transmission over the Internet, email, SMS, or method of electronic storage is completely secure. For this reason All Around Music cannot guarantee absolute security of your Information. If we become aware of a data incident that affects your Personal Information, we will notify you and any applicable regulator where we are legally required to do so.

Section 8: How All Around Music Responds to Compelled Disclosure
All Around Music will not sell or otherwise transfer your private Information except where essential for providing the Services. However, All Around Music will give out Personal Information to comply with applicable law or a court order, to respond to lawful requests by public authorities, to prevent harm or injury, or to prevent fraud or other illegal activity. SMS Text Message Communications
If you provide your mobile number and expressly agree to receive SMS text messages, All Around Music may contact you by SMS for:
a. transactional and Service messages related to your account, lesson bookings, reminders, schedule updates, and Service alerts
b. customer Service messages in response to questions you send by text, when this channel is available
c. marketing messages about new Services, promotions, events, or special offers that may be of interest to you, where you have provided the required consent.

Message frequency will vary based on your interactions with All Around Music. Message and data rates may apply from your mobile carrier.

You can opt out of marketing SMS messages at any time by replying STOP to any SMS message from All Around Music. After you send the SMS message STOP, we will send a confirmation SMS message and you will no longer receive marketing SMS messages from us. For additional help regarding SMS, you may reply HELP or contact us at contact@allaroundmusic.us.
Providing your mobile number and agreeing to receive SMS text messages is optional and is not required in order to purchase or receive Services from All Around Music.

All Around Music may use third party vendors to deliver and manage SMS text messages. These vendors are permitted to use your Information only to support All Around Music in sending and managing those messages.

Section 10: Updates to All Around Music Privacy Policy
All Around Music may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. When we make material changes, we will notify you before any updates take effect by sending an email to the email address associated with your account at least thirty days in advance. The email will include the new Privacy Policy and instructions on how to accept the new Privacy Policy. We may also post a notice on our Website.
